Gavron Warning: Your Alimony For Life Will End
Quick question. How many years were you married? Be specific. Nine years and ten years are two different alimony conversations.
What is a Gavin Warning?
A Gavron warning is a California judge telling the person receiving spousal support to make reasonable, good-faith efforts to become financially self-supporting. Translation: “We’re going to help support you. But eventually, we’d like you to have a source of income that is not your ex”
That could mean getting a job, going back to school, getting training, or otherwise working toward being able to support yourself. And before you panic: a Gavron warning is not the judge handing you a pink slip for your alimony. It’s a warning. The point is that you should know what the court expects and understand that failing to make reasonable efforts toward self-support could eventually affect your spousal support. The supporting spouse or their attorney can ask the court to issue one, and the judge decides whether the circumstances call for it.
WHAT IS THE PURPOSE OF A GAVRON WARNING?
Think of spousal support less like “Congratulations, you have unlocked a lifetime subscription to your ex's checking account” and more like a financial bridge. The idea is to give you some breathing room while you get your financial life moving again: retraining, finishing school, finding work, increasing your earning capacity, or figuring out what employment looks like after years of marriage. Which brings us to the deeply romantic message of family law:
Your divorce may be over. Your financial independence is not.
And yes, the court would like to see some proof that you're doing the work.
HOW LONG IS A LONG TERM MARRIAGE AND HOW DOES THAT AFFECT THINGS?
Married 10 years or more?
California generally treats that as a long marriage, and the court keeps jurisdiction over support indefinitely. A judge can also decide a Gavron warning isn't advisable at all. That doesn't mean support is permanent, and it doesn't mean no one is watching. For instance, as a general rule, marriages lasting shorter than ten years usually allow for alimony periods of half of the length of the marriage, (married 10 years, you’ve got 5 years of alimony possible. Married for less, and it cascades. You get it) whereas long(er)-term marriages (20 years plus) typically allow for longer periods of time.
CAN GAVRON WARNINGS AFFECT CHILD SUPPORT?
No. Gavron warnings apply only to spousal support, never to child support.
HOW TO RESPOND TO A GAVRON WARNING
This can happen verbally in court or in writing often in a divorce judgment or spousal-support order. Note that this is not the moment to put the paperwork in a drawer and hope everyone forgets about it because a failure to make good-faith efforts toward becoming self-supporting can result in the court to modifying your support.
So make a plan. Then document it.
Job hunting? Save the applications.
Training or school? Keep the enrollment records and certificates.
Rejected? Congratulations, that counts as documentation. Keep the rejection emails.
